Welcome to CMAHC.org, the website for the Council for the Model Aquatic Health Code.

BINDING EFFECT. This is a binding agreement. By using the Internet site located at cmahc.org (the "Site") or any services provided in connection with the Site (the "Service"), you agree to abide by these Terms of Use, as they may be amended by the Council for the Model Aquatic Health Code ("CMAHC") from time to time in its sole discretion. CMAHC will post a notice on the Site any time these Terms of Use have been changed or otherwise updated. It is your responsibility to review these Terms of Use periodically, and if at any time you find these Terms of Use unacceptable, you must immediately leave the Site and cease all use of the Service and the Site.

PRIVACY POLICY.The CMAHC respects your privacy and permits you to control the treatment of your personal information. A complete statement of CMAHC’s current privacy policy can be found below.CMAHC’s privacy policy is expressly incorporated into this Agreement by this reference.

When you register for membership in CMAHC you must complete the registration process by providing the complete and accurate information requested on the registration form.

NO WARRANTIES. CMAHC HEREBY DISCLAIMS ALL WARRANTIES. CMAHC IS MAKING THE SITE AVAILABLE "AS IS" WITHOUT WARRANTY OF ANY KIND. YOU ASSUME THE RISK OF ANY AND ALL DAMAGE OR LOSS FROM USE OF, OR INABILITY TO USE, THE SITE OR THE SERVICE. TO THE MAXIMUM EXTENT PERMITTED BY LAW, CMAHC EXPRESSLY DISCLAIMS ANY AND ALL WARRANTIES, EXPRESS OR IMPLIED, REGARDING THE SITE, INCLUDING, BUT NOT LIMITED TO, ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. CMAHC DOES NOT WARRANT THAT THE SITE OR THE SERVICE WILL MEET YOUR REQUIREMENTS OR THAT THE OPERATION OF THE SITE OR THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE.

LIMITED LIABILITY.CMAHC’s LIABILITY TO YOU IS LIMITED. TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL CMAHC BE LIABLE FOR DAMAGES OF ANY KIND (INCLUDING, BUT NOT LIMITED TO, SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES, LOST PROFITS, OR LOST DATA, REGARDLESS OF THE FORESEEABILITY OF THOSE DAMAGES) ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SITE OR ANY OTHER MATERIALS OR SERVICES PROVIDED TO YOU BY CMAHC. This limitation shall apply regardless of whether the damages arise out of breach of contract, tort, or any other legal theory or form of action.

AFFILIATED OR THIRD PARTY SITES.CMAHC has no control over, and no liability for any third party websites or materials. CMAHC works with a number of partners and affiliates whose Internet sites may be linked with the Site. Because neither CMAHC nor the Site has control over the content and performance of these partner and affiliate sites, CMAHC makes no guarantees about the accuracy, currency, content, or quality of the information provided by such sites, and CMAHC assumes no responsibility for unintended, objectionable, inaccurate, misleading, or unlawful content that may reside on those sites. Similarly, from time to time in connection with your use of the Site, you may have access to content items (including, but not limited to, websites) that are owned by third parties. You acknowledge and agree that CMAHC makes no guarantees about, and assumes no responsibility for, the accuracy, currency, content, or quality of this third party content, and that, unless expressly provided otherwise, these Terms of Use shall govern your use of any and all third party content.

GOVERNING LAW. These Terms of Use shall be construed in accordance with and governed by the laws of the United States and the State of Colorado, without reference to their rules regarding conflicts of law. You hereby irrevocably consent to the exclusive jurisdiction of the state or federal courts in Denver County, Colorado, USA in all disputes arising out of or related to the use of the Site or Service.

SEVERABILITY; WAIVER. If, for whatever reason, a court of competent jurisdiction finds any term or condition in these Terms of Use to be unenforceable, all other terms and conditions will remain unaffected and in full force and effect. No waiver of any breach of any provision of these Terms of Use shall constitute a waiver of any prior, concurrent, or subsequent breach of the same or any other provisions hereof, and no waiver shall be effective unless made in writing and signed by an authorized representative of the waiving party.

NO LICENSE. Nothing contained on the Site should be understood as granting you a license to use any of the trademarks, service marks, or logos owned by CMAHC or by any third party.

MODIFICATIONS. CMAHC may, in its sole discretion and without prior notice, (a) revise these Terms of Use; (b) modify the Site and/or the Service; and (c) discontinue the Site and/or Service at any time. CMAHC shall post any revision to these Terms of Use to the Site, and the revision shall be effective immediately on such posting. You agree to review these Terms of Use and other online policies posted on the Site periodically to be aware of any revisions. You agree that, by continuing to use or access the Site following notice of any revision, you shall abide by any such revision.

ACKNOWLEDGEMENT. BY USING THE SERVICE OR ACCESSING THE SITE, YOU ACKNOWLEDGE THAT YOU HAVE READ THESE TERMS OF USE AND AGREE TO BE BOUND BY THEM.

Council for the Model Aquatic Health Code Return and Refund Policy

  1. The CMAHC offers membership in the organization, which for 2015 is $40.00 per person. There is no refund for membership dues. Membership is open to anyone, and you may join at any time.
  2. All CMAHC fees and prices are in U.S. dollars.

Privacy Policy

The Council for the Model Aquatic Health Code (CMAHC) respects the privacy of its members and other visitors to its website. CMAHC strongly believes that consumers should be assured that information provided online is used responsibly and appropriately. To protect online privacy, CMAHC has implemented the following policy.

What Information Does CMAHC Collect?

Most data CMAHC collects are used only to help us better serve our members. It is our general policy to collect and store only personal information that our members and visitors knowingly provide. If our privacy policies change, we will notify all users by special announcement placed on the website.

From General Users

CMAHC does not collect any personal information from users browsing its website. Only aggregate data -- such as the number of page views -- are collected. Aggregate data are only used for internal and marketing purposes and do not provide any personally identifying information.

From CMAHC Members, Conference Registrants, Sponsors, and Other Customers

Information, including name, mailing address, organization name, position title, telephone, and email address, may be submitted to CMAHC through membership applications and conference or workshop registrations. This information is not sold or distributed in any other manner except that it may be provided free of charge to members. By registering with CMAHC, you hereby consent to the disclosure of said information to other registrants.

How Does CMAHC Use Data Collected?

Generally, CMAHC uses data collected to facilitate contact with members, fulfill its vision to promote aquatic health and safety through collaboration, and provide telephone conferencing services to members for conducting CMAHC business.

Disclosure of Personal Information

We may disclose personal information if required to do so by law or in the good-faith belief that such action is necessary to (1) conform to the edicts of the law or comply with legal process served on CMAHC or its subsidiaries, partners, or affiliates, (2) protect and defend the rights or property of CMAHC or the users of the Site, or (3) act under exigent circumstances to protect the safety of the public or users of the Site.

Consent to Use Personal Information

CMAHC or its agents must store, host and otherwise process the information (including personal data) supplied by the user when becoming a member of CMAHC or registering for CMAHC meetings or workshops. CMAHC members, including users of the website at URL www.cmahc.org consent to the use of the information to send the user unsolicited direct mail and email notifications.

Credit Card Account Information

CMAHC uses a third party, PayPal, to collect payment so does not keep records of credit card numbers or use. CMAHC is not responsible for PayPal privacy practices, security policies, activities or actions regarding billing of CMAHC payments. It is your responsibility to review the PayPal privacy policies at those websites to confirm that you understand and agree with their policies.

Third Party Websites

The Site may contain links to other websites. If you choose to visit other websites, we are not responsible for the privacy practices or content of those other websites, and it is your responsibility to review the privacy policies at those websites to confirm that you understand and agree with their policies.
